Once case examiners have made the case to answer decision, they then decide what should happen to the nurse or midwife’s case.

If they decide there is no case to answer, they then consider, applying the guidance on thresholds, whether to give the nurse or midwife advice, issue the nurse or midwife with a warning, or simply close the case.

If case examiners decide the nurse or midwife does have a case to answer, they should consider whether to recommend undertakings to be agreed with the nurse or midwife, or whether it is necessary to refer the case to the Fitness to Practise Committee.
