Raising a concern about a nurse, midwife or nursing associate

We investigate concerns about registered professionals to determine whether their skills, knowledge, education or behaviour fall below the standards needed to deliver safe, effective and kind care.

We act when we think someone on our register poses a risk to the public or what they've done is so serious it would damage the public's trust and confidence in the nursing or midwifery professions.

Examples of serious concerns:

  • abuse of professional position, for example an improper sexual relationship with a patient or someone using a service
  • serious or repeated mistakes in patient care
  • serious criminal offences
  • violence
  • dishonesty or fraud
  • serious breaches of patient confidentiality
  • discrimination against patients, colleagues or others
  • serious concerns about a nurse, midwife or nursing associate’s knowledge of the English language.

Why we might not consider a concern:

  • We understand that sometimes people can make mistakes. Fitness to practise is not about punishing people.
  • Making a mistake doesn’t necessarily mean a professional should be stopped from working. When we look at a concern, we consider whether it was a one-off event, how serious it was, how much they have reflected on what happened and what they have done since to learn from the mistake and to strengthen their practice.

We can only investigate concerns about people on our register (nurses and midwives in the UK, and nursing associates in England). Other regulators might be able to help if your concern is about a different regulated health or care professional.

Healthcare assistants (HCAs) are not regulated in the UK. If you have a complaint about a healthcare assistant, you should raise your concern with the organisation that the healthcare assistant works for.

Concern about a health or care organisation

Have you already raised your concern with the organisation concerned? This is usually the quickest and easiest way to resolve a problem.

We can’t investigate concerns about organisations, only individual nurses, midwives and nursing associates. If your concern relates to the running of an organisation and you are worried the care provided by the organisation could be a risk to others, you should consider contacting one of the following regulators.

Reporting fraud against the NHS

The vast majority of those who use, work in, or interact with the NHS are honest. But a tiny minority commit fraud against the NHS. That could include a nurse, midwife or nursing associate.

Independent organisations are responsible for investigating fraud and other economic crime. They’re the right people to talk to if you become aware of fraud against the NHS.

If they find that someone on our register is involved, they will share information with us as the professional regulator.

Concern about a consumer issue

If you want a refund, compensation or have another consumer issue it’s best to talk to the place you were treated directly as that’s not something we can help with.

Organisations like Citizens Advice can help if you need more support with a consumer problem.

Have you raised this with the nurse, midwife or nursing associate’s employer?

We strongly recommend that you talk to the nurse, midwife or nursing associate’s place of work or employer before you raise your concern with us.

An employer is usually best placed to resolve issues quickly and fairly. They can give you a detailed explanation of what happened and an apology if appropriate. We can’t provide you with either of these things. 

They may then decide to refer someone to us once they've investigated your concern themselves. All the information they gather during an internal investigation can then be used in our own investigations and speed up the process overall.

If you don’t agree with the employer’s response you can complain to the Ombudsman.
