‘My Midwife & Me’: Professional indemnity arrangements
This information is for midwives, women and families who may be affected by the professional indemnity arrangement provided through My Midwife & Me Limited which will end on 30 June 2020
We have been made aware that the professional indemnity arrangement provided through My Midwife & Me Limited comes to an end on 30 June 2020. After this date no midwives will be able to rely on this policy for their professional indemnity cover.
As all midwives must be covered by an appropriate indemnity arrangement, any midwife who is not covered by an alternative indemnity arrangement after this date cannot practise as a midwife.
What is an indemnity arrangement?
Like other regulated healthcare professionals, midwives must have an appropriate indemnity arrangement (also known as insurance) in place to practise and provide care in the UK.
This legal requirement is to make sure that anyone who has suffered harm through the negligent action of a midwife is able to claim any compensation to which they are entitled.
Everyone on our register is responsible for making sure they have the appropriate cover for their role, scope of practice and the risks involved in their practice.
Information for affected midwives
If you’ve been relying on My Midwife & Me to provide your professional indemnity arrangement for any part of your midwifery practice, you should review your indemnity arrangements as soon as possible.

You cannot practise as a midwife after 30 June 2020 if you are not covered by an alternative indemnity arrangement.
If you practise without an appropriate indemnity arrangement in place, you may be removed from our register or be investigated by our fitness to practise department.

If you have a new professional indemnity provider, you can tell us by emailing RegistrarandAppealsSupportTeam@nmc-uk.org.
If you do not have a new professional indemnity provider and are not practising as a midwife, you can also inform us of this or update us once you have a new arrangement in place.

We hope the following will answer some of your questions.
I’m due to give birth soon. Can my ‘My Midwife & Me’ midwife act as my midwife during my labour?
Once a registered midwife has established a professional relationship with a woman they can only attend that woman during a birth if they have appropriate indemnity cover.
Where a registered midwife has established a professional relationship with a woman they cannot subsequently avoid their obligations to hold appropriate indemnity cover by attending the birth as a birthing partner.
Nor can a registered midwife, in any circumstances, avoid the requirement to hold appropriate indemnity cover by attending a birth in a ‘non-midwife’ capacity such as a doula.
How do I find another midwife or service to support me through my birth?
If they are affected by this, your midwife may be able to secure alternative indemnity cover or refer you to another independent provider. Alternatively, they should advise you how you can make contact and book for maternity care with your local NHS provider.

I have only just found out about this. What do I need to do?
My Midwife & Me members were made aware that the indemnity arrangement they relied on was coming to an end in October 2019.
We would have expected midwives to inform the women and families likely to be in their care beyond the 30 June 2020 that they would be unable to provide care beyond this point unless they had an alternative indemnity arrangement in place.
