When we instruct an independent expert their overriding duty is to our decision makers.  They do not have a vested interest in any part or side of the case and therefore are free to express a view on the basis of their expertise and experience alone. In cases which involve a wide ranging factual dispute, or issues about whether one or more nurses or midwives acted appropriately, and where we have reason to believe that the investigation carried out by the healthcare setting may not have been adequate or credible, independent experts can assist us in making decisions and in providing objective evidence about relevant standards of care.
