Following a case to answer decision by the case examiners, we will serve a notice of hearing on the nurse or midwife containing the allegation of impaired fitness to practise  and a charge setting out the alleged facts on which the allegation is based. In preparing the case for a hearing, we will keep the case under review. If on review we decide that it is no longer in the public interest  to continue with the allegation or part of the allegation, we can ‘offer no evidence’ against the nurse or midwife. This means that there will be no findings made against them in respect of the allegation or part of the allegation.
